Microsoft-backed startup OpenAI faced a privacy complaint by advocacy group NOYB for alleged violations related to its generative AI chatbot, ChatGPT, which may contravene EU privacy regulations.
ChatGPT, credited with igniting the GenAI trend in late 2022, boasts the capability to simulate human conversation, generate text summaries, craft poems, and brainstorm ideas for various occasions.

Privacy Complaint
According to NOYB, a public figure filed a complaint as the chatbot provided incorrect responses when asked about his birthday. OpenAI reportedly declined the individual's request to rectify or delete the data, citing technical limitations and failing to disclose details about the data processing.

NOYB lodged a formal complaint with the Austrian data protection authority, urging an investigation into OpenAI's data practices, particularly concerning the accuracy of personal data handled by the company's extensive language models.
Legal Compliance
NOYB's data protection lawyer, Maartje de Graaf, emphasized the necessity for technology companies to ensure their systems comply with legal standards when processing individuals' data. She highlighted the importance of accuracy and transparency in such processes.
OpenAI has previously acknowledged ChatGPT's tendency to produce plausible yet incorrect or nonsensical answers, acknowledging the challenge in rectifying this issue.
