Meta AI Controversy: Brazil Data Ban Shuts Down Operations

In Brazil, Meta suspended the use of Generative Artificial Intelligence (GenAI) after the country’s Data Protection Authority issued a ban. The ban was due to objections to Meta’s new privacy policy. While the company continues discussions with the ANPD to address the agency’s concerns regarding GenAI tech usage, it has decided to suspend its tools.

ANPD Decision

The agency said earlier this month that “due to the imminent risk of serious and irreparable damage to the fundamental rights of the affected data subjects,” it has halted the social media giant’s new privacy policy, which allows access to the user’s personal data to train its GenAI systems. Moreover, it has declared a daily fine of 50,000 reais in case of non-compliance and given Meta five more days to prove its compliance with the decision.

Implications on Innovation

Meta said this move would prove to be a step backwards for innovation, competition in AI development and would further delay providing the benefits of AI to the people of Brazil. This move by the ANPD has also forced U.S. tech giants to withdraw their tools and services from regions with stricter data privacy policies.

Apple's Response

In response to this, Apple, which announced a new AI system called Apple Intelligence last month, said it will not be introducing these features into Europe due to concerns from the Digital Markets Act (DMA). “We are concerned that the interoperability requirements of the DMA could force us to compromise the integrity of our products in ways that risk user privacy and data security,” Apple said to The Wall Street Journal.

Impact on Meta's AI Models

As a result of this ban imposed on Meta, it confirmed that it would be withholding its upcoming multimodal AI models from customers in the region because of the “unpredictable nature of the European regulatory environment.”
