Microsoft-backed startup OpenAI is facing a privacy complaint from the advocacy group NOYB regarding its generative AI chatbot, ChatGPT. The complaint alleges that ChatGPT, known for kickstarting the GenAI boom, provided incorrect information to a public figure, potentially violating EU privacy rules.

ChatGPT is renowned for its ability to mimic human conversation and perform various tasks, such as creating summaries of text, writing poetry, and generating ideas for events. However, NOYB claims that when asked about personal information like a birthday, ChatGPT repeatedly gave wrong answers instead of admitting it lacked the necessary data.

Refusal to Rectify Data

Despite requests from the complainant to correct or delete the inaccurate information, OpenAI allegedly refused, stating that data correction was not feasible. Additionally, the company did not disclose details about the data processing, sources, or recipients involved.

NOYB has lodged a complaint with the Austrian data protection authority, urging an investigation into OpenAI's data processing practices and measures to ensure the accuracy of personal data handled by its language models.

"Companies face challenges in making chatbots like ChatGPT compliant with EU laws when dealing with individual data," remarked Maartje de Graaf, a data protection lawyer at NOYB. She emphasized the importance of technology meeting legal requirements rather than circumventing them.

OpenAI has previously acknowledged ChatGPT's tendency to provide plausible yet incorrect or nonsensical responses, acknowledging the difficulty in resolving this issue.
