Italy's data protection watchdog head, Pasquale Stanzione, announced that Italy is ready to reopen ChatGPT if OpenAI agrees to make useful changes on April 30. OpenAI, which is backed by Microsoft Corporation, halted the chatbot platform's operations in Italy after Italy's data protection authorities temporarily restricted its handling of personal data and launched an investigation into a possible privacy violation.
ChatGPT was a sensation worldwide when it was launched as it was capable of creating essays, songs, examinations, and news pieces from brief prompts. However, there have been criticisms regarding the transparency of how ChatGPT and its competitors obtain their data.
The Italian data protection authorities accused OpenAI of having no legal justification for the massive gathering and storage of personal data necessary to train the algorithms that underlie the platform's functionality. Additionally, the authorities highlighted the ambiguity about whose data was being collected. The company was accused of exposing young people to "absolutely inappropriate answers" and failing to handle incorrect answers offered by the chatbot appropriately.
Therefore, Italy is ready to reopen ChatGPT only if OpenAI removes all references to contractual performance and relies on the accountability principle while choosing either consent or legitimate interest as the applicable legal basis.
