ChatGPT's Return to Italy Depends on OpenAI's Compliance to Privacy Rules
The Italian data protection authority, Garante, has imposed a temporary ban on the AI chatbot, ChatGPT, due to privacy concerns. However, the ban could be lifted if its maker, OpenAI, complies with the outlined privacy rules by the authority.
In response to Garante's temporary ban, which was introduced last month while investigating a possible data breach, OpenAI has been asked to stop processing the personal information of Italian users. Garante emphasized the importance of following the European Union's strict data privacy rules while stating that they do not want to hamper AI's development.
As per Italy's outlined requirements, OpenAI has until April 30 to meet the criteria for ChatGPT to be accessible to its Italian customers.
OpenAI is happy with the move and said, "We are happy that the Italian Garante is reconsidering their decision, and we look forward to working with them to make ChatGPT available to our customers in Italy again soon."
Garante has required OpenAI to display information on its website concerning the processing of personal information of both users and non-users, including why and how it's being processed. Additionally, OpenAI must provide an option to correct or delete the data.
The watchdog further stated that ChatGPT's algorithms could only be trained using personal data if explicit consent or legitimate interest was established. Garante had questioned whether OpenAI could collect vast amounts of data for ChatGPT's algorithms, and raised concerns about the system producing false information about individuals.
OpenAI is also obligated to carry out a publicity campaign by May 15 to inform people about how their personal data is used for training algorithms. There will also be an age verification requirement and an option for filtering out individuals under 13 and teenagers between 13 and 18 who don't have parental consent.
