ChatGPT Faces EU Investigation

EU privacy regulators to investigate ChatGPT

The European Data Protection Board (EDPB) is planning to create a task force to investigate whether OpenAI's ChatGPT is compliant with the EU's General Data Protection Regulation (GDPR). This decision was made after concerns were raised by European privacy watchdogs.

The task force is intended to "foster cooperation and exchange information on possible enforcement actions conducted by data protections authorities." The Italian data protection authority has already taken enforcement action against OpenAI’s ChatGPT service over alleged privacy violations. As a result, the Italian guarantor for the protection of personal data temporarily prohibited the processing of Italian users’ data by ChatGPT’s parent firm OpenAI until the requirements set forth by the EU's privacy laws were met.

The Spanish Agency for Data Protection (AEPD) requested that the discussion of ChatGPT be added to the EDPB's agenda, and the AEPD has initiated an investigation into OpenAI for a possible breach of regulations. The French privacy watchdog, CNIL, is also investigating five complaints against the chatbot.

While there are concerns about ChatGPT's compliance with privacy laws, France's Digital Minister Jean-Noël Barrot argued against banning the chatbot. OpenAI has not yet responded to requests for comment.
