Technology and policy in India are about to face a significant challenge with the introduction of Meta’s Ray-Ban smart glasses in the market. Privacy Concerns with Meta's Smart Glasses
While these smart glasses boast features like hands-free photo capture, real-time translation, and voice commands, the launch has sparked privacy concerns in India. The current data protection laws in the country do not adequately address the potential privacy risks associated with this technology.
Unlike traditional phone cameras where it's easy to spot someone recording, the Meta smart glasses include a small LED light that indicates when recording is active. However, if this LED is covered or blocked, the system notifies the user and disables recording until the obstacle is cleared.
Challenges with Current Data Protection Laws
India's Digital Personal Data Protection (DPDP) Act, while comprehensive in many aspects, falls short when it comes to personal recordings and content shared in public. This creates a loophole that could be exploited by users of smart glasses to bypass legal protections for individuals captured in their recordings.
The 2025 draft rules provide some rights to users to manage their data, but bystanders caught incidentally in recordings lack the necessary link to the platform to exercise these rights. This imbalance of control and access raises concerns about the accountability of users and platforms in safeguarding the privacy of individuals in public spaces.

As wearable devices like smart glasses become more prevalent, the lack of protection for bystanders who may unknowingly be recorded poses a significant challenge.
