OpenAI disputes Indian court's demand to erase ChatGPT data
OpenAI has challenged the jurisdiction of the Delhi High Court to compel the removal of ChatGPT’s training data, citing conflicts with its legal obligations under US law. The case, initiated by Indian news agency ANI, accuses OpenAI of using its content without authorization to train ChatGPT, an AI language model popular in India.
ANI has requested the deletion of its content from the model’s training dataset, claiming copyright infringement. In response, OpenAI argued in an 86-page submission that US laws mandate the preservation of training data during pending litigation, making data removal orders from India incompatible with its legal duties.
Server Location and Jurisdiction Dispute
OpenAI highlighted that the servers storing ChatGPT’s training data are situated outside India, asserting that the Delhi High Court lacks jurisdiction over its operations due to the absence of physical presence or servers in India.
While committing to discontinue the use of ANI’s content moving forward, ANI raised concerns about the existing material incorporated into ChatGPT’s dataset, suggesting risks of unauthorized reproduction. ANI also took issue with OpenAI's commercial agreements with international media outlets, alleging unfair competition and unauthorized replication of its articles by ChatGPT in response to user queries.
Upcoming Court Hearing
The matter is scheduled for a court hearing on Jan. 28, with Reuters clarifying its non-involvement in ANI’s business decisions or legal disputes. This lawsuit forms part of a broader trend of copyright challenges against AI firms accused of misusing copyrighted material for model training.
In a similar vein, OpenAI faces copyright claims in the US, including a notable case filed by The New York Times. The company has consistently defended its AI systems' reliance on publicly available data and adherence to fair use protections.
To further deepen the controversy, ANI insists that the Delhi High Court possess the authority to address its grievances against OpenAI, setting the stage for a legal showdown between the two entities.
