AI Copyright Lawsuits: Updates on 30 Ongoing Cases

Here’s the latest update on all 30 copyright lawsuits against AI companies. Over the past few weeks, there have been minimal developments, possibly due to the end of summer and the slow pace of discovery.

New updates since the last report are denoted with an asterisk*. In the case of Thomson Reuters Enterprise Centre GmbH et al. v. GPT-3, Judge Tigar issued an interesting order in Nazemian v. NVIDIA. This order allows NVIDIA to file a motion for summary judgment on its fair use defense before the court decides whether to certify a class of plaintiffs. Notably, Neal Katyal, the former Acting Solicitor General, is one of the attorneys representing NVIDIA.

We have recently updated our maps to include all US Copyright Lawsuits against AI companies, totaling 30 cases, and all US Copyright & Related Lawsuits, totaling 34 cases. The updates include adding the Millette lawsuits against OpenAI, Google, and NVIDIA involving YouTube videos, as well as Lerhman v. Lovo involving voice-over recordings. Both PDFs now contain clickable links to each docket for easy access.

In other news, the Department of Justice released a press statement regarding the indictment of Michael Smith. Smith is accused of being involved in a deceptive scheme that utilized AI-generated songs and automated bots to artificially generate streams, ultimately amassing $10 million in royalties. Shockingly, the scheme dates back as far as 2017, highlighting the ongoing challenges of fraudulent streaming practices such as "fake streaming" and "bot listening."
